Overview

The Sinclair Broadcast Group, Inc., based in Baltimore, Maryland, is a diverse television broadcasting company, which owns and operates over one hundred stations in over sixty markets around the country. It also provides programming and sales services for its stations under local market agreements (LMA), a concept that was pioneered by SBG in the 1990s. It reaches almost 30% of households in the United States and is one of the biggest broadcasting groups in the country. [1]

History

The Sinclair Broadcast Group, Inc., was founded in 1986 by the four sons of Julian Sinclair Smith, a pioneer in ultra high frequency (UHF) television broadcasting. Julian Smith started the company as the Chesapeake Television Corporation in 1971; under which name Sinclair broadcasted one of the first UHF stations in the country from their flagship station WBFF-TV. UHF broadcasting immediately became a major part in the television industry and started to become more involved with their father’s company in the 1980s.

Julian Smith’s sons began acquiring other UHF stations and quickly saw the Chesapeake Television Corporation become a major consolidator in the industry. The name was changed to the Sinclair Broadcast Group in 1985. In 1990 the Smith brothers bought the remaining shares of SBG, owned by their parents, and immediately began acquiring more stations. It was not long before SBG became one of the largest media distributers in the country. [2]

In Recent News

On May 21st, 2011 Sinclair announced the acquisition of the “Ring of Honor” wrestling franchise. It is the third largest wrestling promotion in the country. Sinclair believes their backing and the power of the relationship between television and wrestling will allow ROH to become a household brand. It will premiere on Sinclair’s vast network of stations, as well as access for people outside of their markets online. ROH will be led by Chief Operating Officer, Joe Koff who was previously the director of sales at Sinclair Broadcasting Group. [6]

On September 8th, 2011 it was announced that Sinclair would be purchasing Four Points Media group for $200 million from affiliates of Cerberus Capital Management, L.P. In this deal they acquired seven different stations from five extremely strong markets in Salt Lake City, West Palm Beach Austin, Texas and Providence, Rhode Island. The acquisition was finalized in January 2012 when they finally received approval from the FCC. [7] [8]

On November 2nd, 2011 Sinclair purchased the broadcast assets of Freedom Communications for $385 million. Freedom Communications reaches over 2% of households over seven different markets. The FCC granted them approval for this deal on March 13, 2012 even though Sinclair had already been managing all of Freedom Communications’ stations since December of 2011. [9]

On February 28th, 2013, Sinclair acquired 24 stations from Barrington Broadcasting Group, LLC. for $370 million. Sinclair will buy 18 of the 24 stations and then will operate and provide sales services for the other 6 stations. They are currently waiting on approval of the FCC and antitrust clearance. However, due to FCC rules, Sinclair has chosen to sell it’s FOX affiliate in Syracuse, NY. They will then purchase a MNT affiliate in Syracuse under a local marketing agreement. Sinclair also announced the purchase certain COX Media stations. They are predicting the combination of these two deals will result in about $232 million of increased equity and $2.85 per share. [10]

Sinclair Broadcast Group has a history of struggling to come to retransmission agreements with the different cable providers. In the past they have had issues with both Time Warner Cable and Comcast and most recently they have finished negotiations with Dish Network and DirecTV. During their negotiations with the Dish Network, Sinclair threatened to black out over seventy channels if they did not come to an agreement by August 13, 2012. Dish Network claimed that Sinclair was charging more than any other broadcaster to carry their channels and Sinclair had doubts of whether or not they would be able to come to an agreement. They did not reach an agreement until August 16, 2012, but fortunately there was no lost signal during the extension. Similar circumstances surrounded their retransmission agreement with DirecTV, however they were able to come to an agreement just hours before 87 channels were due to go black. This deal was made on February 28, 2013.  [11] [12]

Gannett Broadcasting

Gannett Co., Inc.

A Brief Overview

In 1923, Frank Gannet founded Gannett Company, Inc. in Rochester, New York. It began as an extension of Gannett’s newspaper company that was founded in 1906 and has expanded to a multi-media company that no longer just publishes newspapers (1). “Gannett is a media and marketing solutions company with a diverse portfolio of broadcast, digital, mobile and publishing companies.” They own more than 90 daily newspapers, about 1,000 weekly newspapers, 23 television stations and many more media holdings. Gannett operates in 41 U.S. states and six countries (2). Gannett is expanding its brand and as the CEO, Gracia Martore said at the UBS Global Communications Conference, “The media business does not stand still for even a minute we take for granted that change is relentless and we have to show up with our A game everyday.” (3)

Gannett Broadcasting: Company Overview

Gannett Broadcasting’s division is comprised of 23 television stations and its subsidiary Captivate. The former reaches 21 million households in 20 markets, which is approximately 18.2% of the U.S. population (2). The latter is a company that delivers news, information, and advertising through video monitors in elevators. They are currently located in North America and reach more than 4 million workers (4). At the end of 2011, the amount of employees, both full-time and part-time, totaled about 2,600 (5).

Assets

As noted earlier the company owns 23 different television stations across the country, in 21 different markets. Seven of the 21 markets owned by Gannett are in the top 20 market (7).

(20, 21, 22, 23)

The stations are comprised of 12 NBC affiliates, 6 CBS affiliates, 3 ABC affiliates, and two MyNetworkTV affiliates. These affiliation agreements expire with NBC in 2017, with CBS in 2015, and with ABC and MyNetwork TV in 2014. The most successful weekly audiences, based on the November 2011 Nielsen sweeps, are the CBS affiliate in Washington DC (WUSA-TV) with 1,797,000; the NBC affiliate in Atlanta, Georgia (WXIA-TV) with 1,602,000; and the NBC affiliate in Minneapolis-St.Paul, Minnesota (KARE-TV) with 1,297,000. (8)

The ratings of these stations continue to do well. Lucky for Gannett, more than half of its stations are NBC affiliates, and this past November was the first time since 2003 that NBC ranked number one in the Nielsen prime time ratings programming amongst adults 18-49. This increased revenue, as many people tuned into the NBC programming. Furthermore, the past Summer Olympics in London were the most watched games in Olympic history, attracting more than 200 million people. KUSA-TV in Denver was the top rated NBC market affiliate during the two-week span of the games. Their Atlanta and Minneapolis NBC affiliates were ranked second and third respectively; and their St. Louis and Phoenix did well. In total the Gannett owned affiliate stations took six of ten top NBC affiliate markets in terms of ratings during the Olympics (3).

Financial Information

Gannett Company, Inc. is a publicly traded media holding company (GCI). On October 15 the third quarter results were released, and the broadcasting division’s success was monumental. Both revenue and profits were at a record high in all of Gannett broadcasting history. The operating revenue increased 36% from $174.3 million the last 3rd quarter to $237 million during the most recent 3rdquarter.  The television revenue was also up 38.1% from $168.8 million a year ago to $233 million. The substantial increase is mostly attributed to advertising, which includes $41.7 million spent on political advertising and $37 million spent on the summer Olympics related ads. The Olympics brought in an unprecedented amount of revenue from advertising. Their total was up 18% from four years ago during the Beijing Olympic games. Part of the explanation was that Gannett reached out to local advertisers to sell television time to. Lougee is looking to increase the revenue even more during the 2014 Winter Olympic games in Sochi, Russia. In total, political revenue for the year will be $150 million. Prior to the 2012 election, Gannett lacked a strong political footprint, but that changed during this election. Because of more local coverage of elections, especially in swing state markets including Colorado, Florida, and Ohio, political advertising increased by a significant margin. Another source of the revenue came from retransmission fees, which accounted for $22.3 million. With retransmission consent in 2013, Gannett  will receive 135-140 million from distributors, which is up 41 to 46% from 2012. The fourth quarter results are expected to be at an all time high. When the books are closed for Gannett’s fiscal year, the broadcasting division will report record growth and revenue (3) (9).

YTD Stock Price (December 6, 2011-December 6, 2012) (24)

As far as the stock market is concerned, the current share price for GCI is $17.88. Their share price has seen an incline for the most part, as a year ago it was being sold at $13.13 (10) Just recently, a report was released by Dividend Channel that named them the top dividend stock with insider buying. On October 23, the Board of Directors of Gannett announced that a dividend of $0.20 per share would be payable to stockholders just after the new year. As of now the company is on track to return dividends up to $1.3 billion through 2015. Throughout the UBS Global Media and Communications Conference a common theme that both the CEO and CFO spoke about was making sure an increasing level of capital is returned to their shareholders. Furthermore, there is currently a large amount of cash flow totaling over one billion dollars. That money will be used to return even more cash and to invest into things that will expand the Gannett brand (3) (11).

Recent Happenings

Gannett and Dish Network

In late May, Dish Network introduced its Auto Hop feature available on its DVR service. This new technology allows users to skip over commercials on broadcast networks. While this is beneficial for TV viewers it hurts the broadcasters who lose advertising revenue. As a result of this feature, Dish Network and Gannett were having difficulty renewing their retransmission agreements (12). Gannett was looking for a 300% rate increase to compensate for the loss of revenue from advertisers. Dish Network’s stance was that they wanted to take a stand for customer choice and control. Fortunately for subscribers, rather than suffer from a blackout, the two companies reached a deal as the October 7th deadline was slightly extended. The terms of the deal have not been released, but the new contract is long term according to press releases by both companies (13).

Gannett and DirecTV

DirecTV customers narrowly avoided a blackout of Gannett television stations across the country. As the November 30th deadline approached, Gannett warned their viewers that they may experience a blackout of affiliate stations until an agreement was reached. This was all because Gannett was looking for a fair deal for retransmission fees, while DirecTV said that Gannett was trying to get customers to pay almost twice what they pay now for their stations. While the deal was made by the deadline, the details of the agreement have not been made public yet (14).

Brief Network Description

Previously known as Rainbow Media Holdings (a division of the Cablevision, the American cable television company), AMC Networks [1] is a public entertainment company that focuses on specialty television and independent film production based in New York City. Within their branch of premium cable television channels, AMC Networks focuses on producing original content through their multiple channels (AMC, WE tv, the Sundance Channel, and IFC).  On July 1st of 2011, Cablevision made AMC Networks [1] become a publicly traded company, leaving former Rainbow Media president, Josh Sapan, as President and CEO of AMC Networks. Previously recognized for their airing of classic movies, the company began producing original content in 2007 with the launch of programs such as “Mad Men” in AMC (their most popular channel to which the company was named after).

Ever since,  AMC Networks has promoted the creation of high-quality original content in their programming. With hit shows such as “The Walking Dead”, “Mad Men”, and “Breaking Bad”, all of which have received critical acclaim and popular appraisal, AMC Networks has marked its presence in the television industry, especially with through their channel AMC. As their tagline states; “Story matters here.”.

This Year for AMC Networks

Third Quarter 2012 Results

AMC Networks has been seemingly busy this year, given to their known legal dispute [2] with DISH Network early on this summer that led the American cable company to “drop” all of AMC Networks’ programming since this July to early October until the dispute was finalized. A deeper analysis regarding to the  legal dispute and it’s result will continue further along the reading. Given to situations such as the previously stated, the company’s operating income (OI) decreased 8% in its Q3 [3] of this year (in comparison to Q3 of 2011) to a total of $87 million and its AOCF (adjusted operating cash flow) decreased 10.9% to $110 million (Q3 as well). According to AMC Networks’ most recent quarterly report, these blatant decreases in OI and AOCF are due to “ the impact of the litigation and associated carriage dispute with DISH Network.”. Now, OI also decreased due to “flat operating income at national networks and a $9 million increase in the operating loss at International and Other.” Normally when the network refers to its “International and Other” operation, its regarding its independent film production company IFC films, but AMC Networks is currently working on expanding its market on a global scale by opening up markets in Asia, Latin America, Europe, Canada, and Africa. [4]

Regardless of the networks decreasing OI and AOCF, the company has seen a steady increase in net revenues this year by a significant 17% ($332 million by the en of this year’s Q3 ) and an increase of 40% in share value this year (AMCX)[5], a share which is now traded at $52.25.  These revenues, which were off set by their legal disputes, were due to not only the success of their programming but also to their growth in digital and licensing distribution (which is one of the primary reasons for the incitement of their current and past conflicts with cable companies such as DISH Network) through deals with online platforms such as Amazon.com, Netflix, and iTunes. Within their national networks, this led to an increase of 24.3% of revenues to $199 million [3]. Although use of online platforms has increase, Josh Sapan announced at the 40th Annual UBS Global Media and Communications Conference that took place recently on Dec. 4th “Our company has taken a rather more restrained approach on making our shows more accessible online. As a matter of policy its not good for the ecosystem, we chose to very selectively to sell our content.” then adding “We will support it. We will have to carefully manage where our rights go. We are in a position to balance that quite well and we have been compensating it for some time. We will be a good and healthy participant.” while referring to these online platforms [4].

DISH Network and AMC Networks

Now, what is this huge legal mumbo jumbo with DISH Network all about? AMC Networks current strategy consists of profit maximization through affiliate fees [5]. What they do is come up with two to three hit programs (“The Walking Dead”, “Mad Men”, and “Breaking Bad”) which make the channel indispensable to the carrier then fill the rest of the channels programming with inexpensive content such as non-fiction/reality programming (“Comic Book Men”, “Whisker Wars”). As posted in an article by Bill Gurley regarding affiliate fees on Abovethecrowd.com; “How can a cable company not offer “Mad Men”.” And they can’t and AMC knows so. Hence within their contracts they bundle up their other channels and relatively go better off in the contract [5].

dish_logo.jpg

Courtesy of infospace.ischool.syr.edu

“DISH felt that the network had devalued its admittedly popular dramas… by selling them to outlets such as Netflix, iTunes, and Amazon.com” according to an article on fool.com [6]. DISH felt as if they were being cut out and not just that, but AMC was demanding an increase in affiliate fees (which makes sense do to the success of their programs). DISH argued that AMC’s ratings did not meet with their demands.  Given to their disagreements, DISH dropped all programming from AMC Networks in July 2012. But AMC, as well put in fool.com, “won’t be bullied”[6] .

They retaliated by launching ads denouncing DISH’s decision to drop them from programming. With campaigns such as the “Put Zonbies Back” ad that showed footage of people costumed as zombies scrawling through the streets of New York City (in real life) promoting their apocalyptic series “The Walking Dead” and retaliating the carrier’s decision to drop it’s programming.

These campaigns gave way to fan made spoofs and responses that demanded DISH to bring back AMC programming.

They did not stop there. Through their advertising, they gave DISH customers a week to “switch” providers and leave DISH [7].

Many doubted on AMC’s success given that their viewership had decreased 7%-9% in July when compared to 2011, according to the video by the Wall Street Journal [8]. With these decreases in ratings, AMC gave advertisers free time spaces in online streaming trying to push the ratings up.  “You’d be surprised, there’s been a bit of a drop off since the black out started (referring to ratings when DISH dropped AMC)… these are niche products and as a result don’t have the same financial impact.” argued the WSJ [8].

Before the premiere of the third season of “The Walking Dead”, both parties agreed upon a settlement [9]. AMC and Cablevision would receive $700 million and receive a 20% stake with Voom HD, which offers up to 21 channels of HD programming. DISH acquired wireless spectrum licenses that cover up to 45 separate markets.

But the real breakthrough [10]came with the show’s midseason finale that reached 15.2 million viewers on the night of the premiere, a 58% increase in comparison to its previous season finale (yet this was only the mid-season finale) and breaking records for cable television.  It surpassed all other fall programs that appeal to the 18-49 age demographic such as “the Big Bang Theory” and “Modern Family”. Plus, the show’s new follow-up talk show “the Talking Dead” received a viewership of 2.2 million.

CBS Films

by Lisa Kitay

1

History and Overview

CBS Films is a division of CBS Corporation, which is one of the original broadcast companies.[2] CBS is a mass media company that produces and allocates entertainment content that reaches the entire world.  Today it is one of the largest groups of media content companies as well as it owns the most watched Television station in the United States. The film division is just one of their many facets.[3]

4

CBS Films is a baby in the large scope of the entertainment industry. It started in 2007. It has many jobs within its company, including development, financing, production and marketing of theatrical motion pictures. It projects to release four to six films of a wide variety of genres per year with budgets no more than fifty million, but has not been able to debut more that two films per year. They released their first film in the beginning of 2010. CBS films manages the global distribution with partners as well as self-distributing the films in the United States. Currently CBS Films has releases nine films: “The Back –Up Plan”, “Faster”, “The Mechanic”, “Extraordinary Measures”, “Beastly”, “The Woman in Black”, “Salmon Fishing in the Yemen”, “The Words”, and “Seven Psychopaths”.[5]

Fall of 2012 Happenings

6

In October of 2012, CBS Films released Seven Psychopaths.  This has been their second release in 2012. Even though it opened in ninth place making $ 4.17 million[7], Seven Psychopaths earned two nominations for Independent Spirit Awards for the Best Original Screenplay and Best Supporting Male categories.  Writer and Director, Martin McDonagh is up for the award of Best Screenplay and Sam Rockwell for Best Supporting Male.[8] McDonagh has also written and directed “In Bruges”. In addition he has also produced many short films.[9] Rockwell has been seen on screens in many occasions and will be seen in films to come. Some of his leading roles include “Lawn Dogs”, “Confessions of a Dangerous Mind”, and “Choke”.[10]

11

Even though this picture is receiving nominations, CBS was disappointed in the response from its audience. The weekend report on boxofficemojo.com said that it earned the “lowest nationwide opening ever for CBS Films”. The demographic for this film is male age twenty-five and up. It only opened in half as many theaters as its competing movies during its opening weekend, which could have contributed to its minimal box office gross. CBS Films predicted it would make forty percent more upon its release. It has not been determined the exact reason for its low outcome, but the small demographic that it appeals to is said to have an impact. [12]

According to boxofficemojo.com, Seven Psychopaths ranked 19 in the quarterly reports. It had a total gross of $14,666,353 and was released in 1,480 theaters.[13]

This film follows Colin Farrell who plays a struggling screenwriter in Los Angeles. He entangles himself in the web of the criminal underworld because Christopher Walken and Sam Rockwell decide to steal a dog.[14]

15

[16]

Following their release of Seven Psychopaths, CBS Films accomplished something that has never been done before. After long negotiations, four of Hollywood’s most acclaimed actors will be seen on the big screen at once. On November 15th, CBS announced that in late 2013 “Last Vegas” will be released in theaters. With a cast consisting of Michael Douglas, Robert De Niro, Morgan Freeman and Kevin Kline, this film will be the premiere of these Oscar nominated actors on screen simultaneously. This movie, which has a plot that follows the four friends around Las Vegas for the bachelor party of the last friend to walk down the aisle, has a budget of $16.6 billion. CBS is working with Good Universe to produce and distribute this film that Jon Tureltaub will direct and Dan Fogelman will write.[17]

18

Following a similar trend, CBS Films announced its plan to release another 2013 movie with major stars as its leading actors. Like “Last Vegas”, they have also connected Rachel Bilson and Andy Samberg to a movie coming out Valentines Day of 2013 called “The To Do List“.[19]

They also attempted to attach “Thor” actor, Chris Hemsworth, for the leading role in their production of “American Assassin”, a film based on the novel by Vince Flynn. He reported rejected due to scheduling time conflicts.[20]

21

Even though Scott Derrickson is not a leading actor in Hollywood, in the directing world he is very highly recognized. He has previously directed projects such as “Sinister” which was released early this year, as well as the Exorcism of Emily Rose.[22] CBS Films has attached him to making the iconic video game, “Deus Ex: Human Revolution” into a screenplay.[23] He will not only direct this film but write the screenplay as well.  It will take place in the near future when major scientific advances debut focusing on human augmentation.  The main character, an ex-SWAT security specialist, must take on mechanical augmentation to be able to figure out a global conspiracy.[24]

25

In addition to attaching big name industry personal to their projects in the month of November, CBS also announced that it acquired the distribution rights to The Last Exorcism Part II from studiocanal. This is the sequel of The Last Exorcism, which grossed more than $20 million its opening weekend. Ed Gass-Donnelly will direct this film, which will continue from where the last film left off. Star Ashley Bell, is found abandoned in the woods with no recollection of the previous months. As she begins to live her new life, the evil force possesses her body again stating the exorcism over again. This film is said to be released march of 2013. Scott Shooman, who is the Executive Vice President of Acquisitions and Co-Productions, collaborated with Harold van Lier of Studiocanel. [26]

27

Money, Money, Money

As a corporation as a whole, CBS has had a 5.4% profit increase from 2010 to 2011 reaching $1,276 billion revenue in just movies, TV production, and video games alone.[28] In 2012, at the end of September, the entertainment segment of CBS had total revenue of $ 1,680 million; compared to the previous year it had $ 1,632 million.[29] Even though there is no concrete source to confirm this, from the comparison between 2011 and 2012, I can assume that CBS’s profit slightly increased from numbers in 2011. And although the third quarter results released by CBS Corporate did not include CBS Films specifically in their entertainment segment with their individual earnings, they are included in the total number given.

The most recent release, “Seven Psychopaths”, ranked sixth making a total gross of $ 14,676,509. CBS Films in total has profited $219,338,027[30] from their entire collection of movies since they opened their doors in 2007.[31]

Important People

Five specific individuals keep CBS Films active. Wolfgang Hammer[33], who has also been the COO of CBS Films, oversees business, finance, legal affairs and acquisitions. Joining the company in April, Terry Press is head of the creative distribution, marketing and the physical production.[34]  On December 5th, 2012 she was ranked number 71 in The Hollywood Reporter’s Women in Entertainment: Power 100.[35] Steven Friedlander, the Executive Vice President of Theatrical Distribution is in charge of the domestic theatrical acquisitions and distributions.[36] Rik Toulon who has been recognized as a leading attorney for media and entertainment in California and noted in Best Lawyers in America, is the Executive Vice President and General Counsel. As this title he oversees all the legal activities and is involved with the company’s distribution, finance, acquisition, key vendor and strategic alliance arrangements.[37] Lastly, Maria Faillace holds her second job at CBS films as Executive Vice President of Production. There is she in control the production for the division’s homegrown titles.[38]

Coming up in 2013

CBS Films has yet to reach its quota of releasing six films a year, but 2013 will be different. “Last Vegas” is in production now and has a projected release date of Christmas of 2013. “Gambit” is complete and is also to be released in December 2013. “7500” and “Get a Job” are both in post-production now. ” The To Do List” and the “Last Exorcism Part II” are also on the horizon to come to theaters this year.[39]

About

Originally founded as Paxson Communications in 1991, ION Media Networks was officially established in 2006 and has since made great lengths in all of its key areas including: general entertainment television, special interest television, and mobile television. ION is a leading American television provider and brings their content to nearly 260 million Americans. They deliver their entertainment “through innovation, offering quality content, new formats and innovative packages that are affordable and accessible to all consumers” [5]. At its helm is CEO and Chairman Brandon Burgess along with Chris Addeo in Marketing, Douglas Holloway in Distribution, and Jeff Quinn in Finance. Under the ION Media Networks Inc. flagship is ION Television, Qubo, and ION Life.

Holdings

Under the networks’ “Positively Entertaining” brand, ION Television offers an array of blockbuster movie titles, hit shows in syndication, and more recently, a jump into original content. The network reaches more than 1oo million US Homes and boasts it is “the only entertainment network with double-digit growth” [11]. It is available through all major distribution companies and is one of the fastest growing networks in America.

Qubo, ION’s “Good Fun” children’s network provides a safe space for childhood and adult viewing. It functions to provide content for preschoolers to tweens and tries to promote good role models and values in order to create more constructive members of society. It has also received numerous awards for its healthy programming and fight against childhood obesity. It has been recognized as the “Gold Standard” in kid’s television by the FCC and was also voted as “one of the more trustworthy sources for children’s programming” by the U.S. Government Accountability Office [12].

ION’s final special interest television venture is ION Life, a lifestyle channel that is

committed to offering programming that promotes healthy and active individuals. Its programs focus on such topics as relationships, inspirational stories, adventure, and home design. It is available 24/7 and is distributed over-the-air and through cable and satellite providers.

Financials

In May of 2009, ION Media Networks hit a serious road block.  Under the deal of a restructuring agreement with a group of debt holders whom promised they would make its debt into equity, the network filed for Chapter 11 bankruptcy. With more than a billion dollars in liabilities and ten million in assets, ION rebuilt with a 150 million dollar funding commitment. However, by October of 2010, ION had resurrected from the ashes of bankruptcy. “Per Nielsen ratings data, ION Television averaged 1.12 million viewers in the third quarter of 2010, an improvement of 94 percent versus the year-ago period” [1]. This spur in growth is most attributed to the networks’ acquisition of shows such as Criminal Minds and Without a Trace and “from October 2009 through September 2010, ION has

Douglas Holloway – President of Multichannel Distribution

grown its overall sales prime deliveries 72 percent to 1.01 million viewers, while improving 74 percent among adults 25-54 (450,000), and nearly doubling its delivery of viewers 18-49 (392,000 versus 205,000 in the year-ago period)“ [1]. Although ION is a private company and therefore does not publish their financial reports to the public, in a talk earlier this month, ION’s President of Multichannel Distribution confirmed that the company is continuing on its up-hill climb.

In the News

ION is also a leader in developing the future of mobile television and “co-founded the industry initiative to develop Mobile DTV technology in record time” [5]. This initiative, the Mobile Content Venture, or MVC for short, was also headed by NBCUniversal and Fox. In order to “mobolize” this project, these broadcasters plan to use the Dyle mobile TV service. Dyle mobile TV is working to turn Android and iOS devices into portable televisions and will allow customers to view local broadcast channels such as ABC, CBS, FOX, NBC, Quobo, Telemundo, and Univision. However, this program is not yet covered in all markets. In a presentation this month at Syracuse University’s S.I. Newhouse School of Public Communications, ION’s President of Multichannel Distribution, Douglas Holloway, expressed qualms about Dyle’s business model, which at the moment will be entirely based on advertising. Holloway also expressed his concerns about his company’s failure to move at a fast enough rate with the expanding mobile TV platform. He said that creating their own distributable platforms are at the moment nearly impossible. This is mainly due to the fact that ION television is entirely syndication based.

Continuing to strengthen its syndicated content, ION Television announced its acquisition of “Law & Order: Criminal Intent,” in early August of 2012.  This off-networking licensing agreement has given the network the rights to all 10 seasons including all 195 episodes [7]. Similarly, in the same month, ION also acquired the off-net rights to all six seasons of the CBS procedural drama “Numb3rs,” which fits in perfectly with the networks’ crime drama line up [14].

In late September, ION Television announced what would be their most successful programming of the fall season. On October 3rd, the network premiered the first match of the new WWE Main Event series. The new show was promoted with several promo ads, “featuring the WWE Superstars and Divas of Monday Night Raw and Friday Night Smackdown” [9]. The series will premiere live events that are filmed across the country, including an international matchup in Europe. Since its debut, WWE Main Event has been a serious contender in television ratings. Up against a presidential debate on its premiere night, this program, according to Nielson, “garnered the highest male audience in the last year with the most Men 18-49 (422,000), Men 25-54 (444,000), and Men 2+ (876,000)” and was also the #4 program on television among Men 18-49. [9]. This beat not only the male audience watching the presidential debate, but it also beat out ESPN and ESPN2 on the last MLB regular season game. CEO Brandon Burgess describes, “’Fans of the WWE are passionate and seem to have a knack for finding their favorite Superstars wherever they live. Needless to say, we are particularly pleased that WWE has found a new home on ION Television, and we congratulate our new partner in the success of the premiere’” [9]. Vince McMahon , CEO and Chairman of WWE, responded, “’We expect our fans will make WWE Main Event the number one show on the network as they have done for WWE programs with all of our other TV partners’”[9].

On October 9, it was announced that ION had created a new and much longer-term partnership with DIRECTV, a leader in digital entertainment service providers. This has extended ION Television’s contract with the provider for many years to come. Also, for the first time, the network will be offered in high-definition on DIRECTV and will also be available nationwide, from East Coast to West Coast.

Another piece of programming proving to be a serious asset for the network this fall is its “nail-biting cop drama,” Flashpoint. Back in late January of 2011, ION Television made a deal with CBS Television for the “rights to all existing episodes and future production of the popular police drama”[10].  In this deal, they were given the rights to produce the fifth season of the drama and all subsequent seasons that may occur, which celebrates the networks’ first experience in creating its own original content. On October 16 of this year, the fifth (and final) season of the original crime drama premiered on the ION Television network. The season will include thirteen, one-hour episodes produced by Pink Sky Entertainment and Avamar Entertainment in association with CTV and ION Television. According to a Canadian television website, the show is “averaging 1.7 million viewers, up 13% from last fall’s season average” [13].

In The News

Seven Psychopaths

CBS Films most recent release is the film Seven Psychopaths starring Colin FarrellWoody Harrelson and Christopher Walken. The movie opened on October 12th and tells the story of a struggling writer who gets roped into the criminal world of dog kidnapping by a few of his friends. During its opening week the film made $5.8 million and around $4 million the week after. The overall budget for the film was $15 million and the film has made about $14 million to date.  Despite its somewhat quiet opening week earnings the film has been very well received and garnered a large number of positive reviews. [4] [5]

In addition to the movie’s cult like popularity it was also recognized by Film Independent, a non profit art organizations which produces the Film Independent Spirit Awards every year since its inception in 1986. Film Independent announced the nominees for each category this past November and Seven Psychopaths received two nominations in two different categories. The first nomination went to Sam Rockwell for Best Supporting Actor and the second nomination was awarded to Martin McDonagh for the “Best Screenplay” category. [4] [6] [7]

The marketing strategy for the film was quite original. Shortly before the movie came out posters started appearing in Hollywood, California for Woody Harrelson’s missing dog.

This was of course a take off on the dog that is stolen from his character in the movie. In addition to the posters a Twitter account for his movie character Charlie Costello, was created. [8]

Seven Psychopaths received the Toronto Film Festival’s Midnight Madness People’s Choice Award. This was the first time a movie released by CBS Films won any type of award. Seven Psychopaths is the second and final release by the company this year. [9}

 The Words

The Words was the first film released on September 7th, 2012 and was the first movie released by CBS Films this year. The Words had the third worst opening weekend of the year for any film as it made just $4.75 million (only Seeking a Friend for the End of the World and People Like Us had worse opening weekends at $3.8 million and $4.3 million respectively). [10] [11]

CBS Films purchased the distribution rights to The Words for $2 million, after the film debuted at the Sundance Film Festival earlier this year. [16]

CBS Films did their best to market the film in an attractive way. However, there was backlash as some felt the commercials and trailers for the film were too vague and did not provide enough of an idea as to what the film was about. [10]

CBS Films created a rather original marketing tactic when they encouraged fans of their Facebook page to help write a short story that had the possibility of appearing in the film. They selected the story ideas of 20 finalist who helped complete a short story entitled “No Promises” and each received a free kindle as a prize for their part of the story being selected for the final manuscript. The object of the contest was to create an interactive marketing campaign for the film. Box Office Mojo cited several possible reasons for the films disappointing opening weekend including the fact that for many it was the back to school time of the year which could have had a harsh impact on the film because of it’s PG-13 rating, meaning it was aimed more towards young adults as well as those in their early to mid twenties. [10][12]

The words was produced independently for about $6 million and the film has made $11.4 million domestically and $350,000 oversees to date. [11]

Deus Ex: The Movie

November 15th, 2012 marked a busy day for CBS Films as the company made big news in the film industry on two different fronts. The first story to surface was the announcement that CBS Films will be releasing a movie adaptation of the highly acclaimed video game Deus Ex: Human Revolution. The game launched in 2011 and received critical appraise from the majority of reviewers. [13]

CBS Films has announced they have signed Scott Derrickson to both direct and wirte the screenplay for the film. Derrickson recently directed the financially successful horror film Sinister, which opened last October and has made over $50 million on a budget of just $3 million. [14] [15]

The production of the film will be overseen by Maria Faillace and CBS Films Creative Executive Alex Ginno. The news of CBS’s film adaptation of the video game was met with generally positive reaction. The game collected over 100 awards including a nomination for overall game of the year for 2011 and is expected to translate well to film due to its strong narrative. [15] [17] [18]

The Last Exorcism Part 2

The second bit of news to break on November 15th was CBS Films announcing they acquired the distribution rights to the sequel of the extremely popular horror movie The Last Exorcism Part 2 from Studiocanal. The film is scheduled to be released March 2013 and will be directed by Ed Glass-Donnelly. Ashley Bell will return to reprise her role as the film’s protagonist. [19] [20]

Scott Shooman negotiated the deal with Studiocanal, which gives CBS Films the rights to distribution but allows Studiocanal to retain distribution rights in France, Germany and the United Kingdom. The previous film surpassed expectations and earned $20 million, while the sequel has been entirely financed by Studiocanal. [19] [21]

Last Vegas

November 5th, 2012 marked one of the company’s biggest announcements to date. The announcement concerned the filming and 2013 release of the movie Last Vegas which will star Morgan Freeman, Robert De Niro, Kevin Kilne and Michael Douglass. The film will be directed by John Turteltaub, while Adam Brooks and Dan Fogelman write the screenplay. [4]

The movie will follow the story of four men in their late sixties who decide to throw a bachelor party for the only one of them who is still single. This film will mark the first time in history that these four men will appear on the same screen together. Between the four men they have collected six Oscar wins and a total of fourteen nominations. [22]

 CBS Films Future

In October it was reported by The Hollywood Reporter that Sony Pictures has struggled in both 2011 and 2012 suffering revenue losses from the films they’ve released. Rumors have been circulating that the division of Sony may soon hit the open market and be available for purchase,. something Sony President Kaz Hirai has denied stating that “There is no reason to sell these industry-leading businesses, and no consideration is being given to the idea.. In a recent interview, head of CBS Corporation Leslie Moonves was asked about his interest in Sony Pictures should it become available for purchase. Moonves said he would highly consider making the purchase should the opportunity arise. “We love our current portfolio, but as a content company, we would want to look at them,” [23] [24]
